All online orders made through our website and the use of all web links provided for this purpose are subject to the following Terms and Conditions of Party Dreams e.U., Steinrieglstrasse 170, 3400 Weidlingbach, Austria (henceforth referred to as “PartyDreams”).

Orders are processed exclusively through our website. The placing of an order by the customer represents an offer. The customer is bound by this offer 14 days after having received the ordered items. We are not obliged to accept an order. For our part, a contract is only concluded once we have accepted the order or, at the latest, once the ordered items have been dispatched. Once the order process has been completed the customer is informed via the window “Your order has been completed and has been sent”. Furthermore, the customer will receive confirmation that his order has been completed via an e-mail sent to the e-mail address provided by the customer. The contract language is German or English.

The purchase agreement will not be stored by us and can no longer be accessed once the order has been completed. However, the customer can print his ordering data immediately after the order has been sent.

Our current range of items can be viewed on the regularly updated website of “Partydreams”. Items are always dispatched from our depot. The availability of items may vary according to the number of items sold during any given period. In the case of unusually long delivery delays, the customer will be informed via e-mail. All deliveries are made via postal or courier service. Unless otherwise expressly agreed, the transportation costs and risks of delivery have to be borne by the customer. Should the customer request an express delivery, separate charges will apply.

Any product information and all prices stated on / are non-binding and subject to confirmation. All prices quoted on the website are inclusive of all taxes, including VAT and duties. Our sales prices do not include postage and packaging, which will be charged separately. The customer can choose one of the following methods of payment: a) Payment in full via credit card upon conclusion of the contract b) Advance payment upon completion of web order Please note: depending upon the country of destination, excluding EU countries, different import duties and charges may be applied. These are to be paid by the recipient upon delivery.

In accordance with the Distance Selling Act, customers have the right to return any items during a period of 14 calendar days beginning with the day on which the items are received. The customer can withdraw from the contract in writing and without specifying reasons within this stated period of time. Saturdays, Sundays and holidays are included in the calculation of that period. In the case of a cancellation, customers will only be refunded the purchasing price upon the return of the purchased goods. Goods should be returned unused and in resalable condition as well as in their original packaging. Should the items be affected by signs of use that have not been caused by their customary and intended usage, we reserve the right to claim compensation for the resulting decrease in value. The same applies where items are returned with accessories or parts missing.

Legal warranty provisions apply. The customer’s right to claim compensation for whatever legal reasons only applies in cases of intent and gross negligence on the part of “Partydreams”. This does not apply to personal injuries.

The place of fulfilment for our services is the registered office of Party Dreams e.U.

On its website, “Partydreams” provides links to other websites on the internet. “Partydreams” expressly declares that it has no influence whatsoever over the design and content of these linked websites.

Should individual stipulations of these Terms and Conditions be revoked or become void, it does not affect the validity of the other terms. We recommend that declarations, notifications etc. intended for us be addressed to us in writing, with the exception of notifications of defects.

When processing data, especially when gathering, storing and passing on information about the customer, “Partydreams” observes the legal provisions concerning data protection. The same applies to using personal data for our own advertising purposes or those of third parties. Customers have the right to revoke their consent to their personal data being used or passed on to third parties for advertising purposes at any time by sending an e-mail to office@partydreams.at.

Customers agree to receive updates from “Partydreams” on products, current offers and other information via e-mail, especially newsletters. Customers can revoke their consent to receiving such e-mails at any point by replying to the sender address with the reference “I do not wish to receive further promotional e-mails”.

The present Terms and Conditions are subject to Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. For any disputes arising from these Terms and Conditions involving customers whose permanent place of residence, habitual place of residence or place of employment is Austria, the competent court is the court of the judicial district in which the customer has his permanent place of residence, his habitual place of residence or his place of employment. For customers who at the time of the conclusion of the contract are non-domiciled in Austria, other legal places of jurisdiction apply.
